  In today’s digital landscape, cyber-attacks have become pervasive, impacting businesses of all industries and sizes. The consequences of such attacks are far-reaching, often resulting in litigation, liabilities, and substantial settlements. To safeguard against the potentially devastating fallout of a large-scale cybersecurity incident, the Board and C-suite executives must understand their pivotal roles in managing and mitigating these risks.

  In this presentation titled Best Practices and Strategies for Managing and Mitigating Cybersecurity Risk from The Board to The C-suite, Daniel Garrie, Esq. (Zeichner Ellman and Krause Partner and Founder of Law & Forensics) and George Pierce, Esq. (Zeichner Ellman and Krause Special Counsel and Law & Forensics Expert Consultant) will address the increasing cybersecurity threats that impact businesses across all sectors. They will discuss critical strategies for the Board and C-suite executives to manage and mitigate these cyber risks effectively. The session will cover various aspects, such as understanding the legal, business, and technical dimensions of cybersecurity, compliance with regulatory requirements promulgated by the Securities and Exchange Commission and the Federal Trade Commission and employing proactive risk management strategies through internal cybersecurity audits, assessments and prevention mechanisms.

  Attendees will gain insights into how businesses can implement cybersecurity best practices to safeguard against the legal and financial repercussions of a cyber incident and navigating complex regulatory landscapes so corporate leaders can make informed decisions, ensuring their organizations’ resilience in the face of ever present and growing cyber threats.

  Daniel Garrie is the Co-Founder of Law & Forensics LLC, Head of Computer Forensics and Cyber Security Practice Groups and has been a dominant voice in the computer forensic and cybersecurity space for over 20 years. Prior to Daniel’s legal career, he successfully built and sold several technology start-up companies. Since co-founding Law & Forensics LLC in 2008, Daniel has built it into one of the leading boutique cybersecurity forensic engineering firms in the industry. Daniel has both a Bachelor’s and a Master’s Degree in computer science from Brandeis University, as well as a J.D. degree from Rutgers Law School. Daniel has led forensic teams in some of the most visible and sensitive cyber incidents in the United States.

  Daniel regularly testifies as an e-discovery, cybersecurity and computer forensic expert witness, authoring forensic expert reports on multi-million-dollar disputes. His ability to perform complex investigations and effectively communicate the results to a jury has made him one of the most sought-after experts in the country. His testimony has been pivotal in a number of cases. Since 2008, Daniel has served as a Neutral and Special Master and in 2016, he joined JAMS as one of the organization’s youngest Neutrals. At JAMS, Daniel serves as an Arbitrator, Forensic Neutral, and technical Special Master with a focus on cybersecurity, cyrptocurrency, and complex software and technology related disputes.

  Daniel is well-published in the cybersecurity space, Editor-in-Chief of the Journal of Law & Cyberwarfare, author of more than 200 articles and books including, “Understanding Software, the Internet, Mobile Computing, and the Cloud. A guide for Judges”, published by the Federal Judicial Center. He has been recognized by several United States Supreme Court Justices for his legal scholarship and is a trusted source and a thought leader for cybersecurity articles and opinions, being cited over 500 times to date.


George A. Pierce

  George Pierce is Special Counsel to the Cyber Security and Litigation Practices at Zeichner Ellman & Krause. He has substantial experience and expertise in providing legal services related to complex litigation, corporate governance, labor and employment, bankruptcy, international trade, regulatory compliance and cyber security matters. Mr. Pierce retired from Toyota Tsusho America, Inc. in December 2022 where he was employed for 29 years and served as a Director, Senior Vice President, Chief Legal Officer, Chief Compliance Officer, and Corporate Secretary. He established the company’s Legal Department as its first General Counsel, and continuously served on Toyota Tsusho America’s board of directors for 22 years when he became the company’s first Director Emeritus and Special Legal Counsel. He also served on the boards of directors of several subsidiary companies.

  Before joining Toyota Tsusho America, Mr. Pierce was associated with Mudge Rose Guthrie Alexander and Ferdon for 12 years where he had extensive experience representing Japanese corporations, Japanese owned subsidiary corporations and domestically owned corporations regarding various complex litigation, international trade, regulatory compliance, environmental insurance coverage, white collar defense, labor and employment, and internal investigations. Prior to Mudge Rose, Mr. Pierce was an intern at Miyake and Kitamura in Tokyo, Japan, which together with Mudge Rose, was counsel to a Japanese corporation that was a defendant in a large complex multinational litigation matter filed in New York State Court.

  Mr. Pierce’s experience with Japanese corporations and Japanese owned subsidiary corporations has largely focused on avoiding and resolving legal issues in the United States by bridging the understanding and expectations gap arising from significant differences between the law and legal systems in Japan and in the United States; For example, as to civil and criminal procedure and the evidence preservation and discovery process in the United States, shareholder liability, jurisdiction over Japanese parent companies in the United States, corporate governance, regulatory compliance, labor and employment, cyber and privacy, and development of policies and procedures that mitigate risk of liability.

  Focusing on Japanese parent and subsidiary corporations in the United States, Mr. Pierce has spoken on labor and employment issues at meetings of the American Bar Association, the International Section of the New York State Bar Association, the International Bar Association and the Asian American Bar Association, as well as the Practicing Law Institute, the American Chamber of Commerce in Japan, the Japanese Chamber of Commerce and Industry of New York, and the Japan Society. He has also spoken at various webinars and CLE programs sponsored by Thomson Reuters, West LegalEd Center regarding cyber security matters, and at the Journal of Law and Cyber Warfare annual symposium. He has also co-taught sessions of the Illinois Institute of Technology’s Chicago-Kent College of Law Cyber Security Certificate Program.
